Future Rewards Privacy Notice

What is this document? Pursuant to art. 13 and 14 of European Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”) and in compliance with the principles contained therein, NATIX intends to inform you (“User” or “you”) about the processing of personal data that occurs when you voluntarily opt in to the Future Rewards Program operated by NATIX Network Limited (the “Future Rewards Program”). The Future Rewards Program enables NATIX to identify and contact users who previously participated in Campaigns through the NATIX Drive& app (the “Campaigns”) and who may be eligible to receive future potential rewards from NATIX Network Limited.

1. Who processes information about me?

We are NATIX Network Limited (hereinafter “NATIX”, “Controller” or “we”, pursuant to art. 4(7) GDPR) with registered offices in Asia Leading, Chambers, Road Town, Tortola VG1110, British Virgin Islands.

The terms and definitions used in this Privacy Policy have the same meaning as in the Campaign Terms, unless otherwise stipulated in this Privacy Policy.

DISCLAIMER. This Privacy Policy covers our use of any information that can or could be used to identify you (“Personal Data”). It does not cover information which cannot be used to identify you (“Anonymous Data”).

2. Scope of this Privacy Policy

This Privacy Policy applies exclusively to the processing of personal data carried out in connection with your voluntary opt-in to the Future Rewards Program. The opt-in is offered solely for the purpose of allowing NATIX to identify and contact past Campaign participants who may be eligible to receive future potential rewards from NATIX Network Limited. The opt-in itself does not entitle you to any specific reward, and eligibility for any future reward (if and when offered) is determined at the sole discretion of NATIX.

Your participation in the Campaigns itself and the related processing of personal data is governed by the separate Privacy Policy available at https://docs.natix.network/policies/privacy-policy-campaign.

3. What Personal Data do we collect?

In connection with your opt-in to the Future Rewards Program, we process the following categories of Personal Data:

  1. Contact Data – your email address and/or phone number that you previously associated with your account during your participation in Campaigns.

  2. Campaign Performance Data – your ranks (positions) in the Cycles you participated in within the Drive& Campaigns.

We do not collect special categories of personal data (such as details about your racial or ethnic origin, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, or health information). We also do not collect information about criminal convictions and offences.

NATIX firmly stands by its commitment not to sell any personal data of our users. The Personal Data collected under this Privacy Policy is used solely for the purposes described herein.

4. How do we collect your Personal Data?

4.1. Personal Data you provide to NATIX

You provide your explicit consent to opt in to the Future Rewards Program through a dedicated opt-in mechanism. The email address and/or phone number associated with your opt-in is the one you previously registered or used in connection with your Campaign participation.

4.2. Personal Data we associate from your prior Campaign participation

Once you opt in, we associate your Contact Data with your Campaign Performance Data (your ranks within the Cycles you participated in), which is already recorded in our systems as a result of your previous participation in Campaigns.

5. How and why do we process your Personal Data?

The sole legal basis for our processing of your Personal Data in connection with the Future Rewards Program is your explicit consent pursuant to art. 6(1)(a) GDPR.

The purposes for which we process your Personal Data are:

  1. To identify users who participated in past Campaigns and who may be eligible to receive future potential rewards from NATIX Network Limited.

  2. To contact you in the future, via the email address or phone number you provided, regarding any future potential rewards, your eligibility, and the steps (if any) required to claim such rewards.

  3. To verify, using your Campaign Performance Data (Cycle ranks), whether and to what extent you may qualify for any future potential reward that NATIX may decide to offer at its sole discretion.

You may withdraw your consent at any time, free of charge and without unjustified limitations, by sending an email to [email protected]. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal (art. 7(3) GDPR).

We do not engage in automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you on the basis of the Personal Data processed under this Privacy Policy.

Provision of your Personal Data under this Privacy Policy is entirely voluntary. If you do not provide your Personal Data, or if you withdraw your consent, we will not be able to identify you as a potential recipient of future rewards or contact you in this regard.

6. Children’s Privacy

The Future Rewards Program is not directed at children. NATIX does not knowingly collect or solicit personal data from individuals under the age of 18 in connection with this opt-in. If we learn that we have collected personal data from a person under the age of 18, we will take prompt steps to delete that information from our systems.

7. Processing modalities

The processing of Personal Data takes place through automated and/or manual tools, subject to appropriate technical and organisational security measures designed to prevent unauthorised access, disclosure, loss, alteration, or other unlawful or unauthorised use of the data.

8. Data sharing

Personal Data processed in connection with the Future Rewards Program is processed solely by NATIX and by internal staff specifically authorised pursuant to art. 29 GDPR. We do not share this Personal Data with any third-party sub-processors, external service providers, or business partners.

Notwithstanding the above, your Personal Data may be disclosed to:

  • public authorities, if and to the extent NATIX is required to do so under applicable law, court order, or order of a competent authority; and

  • external legal advisors, where strictly necessary for the establishment, exercise, or defence of legal claims.

In the event that NATIX engages any sub-processor or third party for the processing described in this Privacy Policy in the future, this Privacy Policy will be updated accordingly and, where required by GDPR, your additional consent will be requested.

9. Data Processing Locations

Personal Data processed under this Privacy Policy is stored and processed exclusively within the European Economic Area (EEA). No personal data is transferred outside the EEA in connection with the Future Rewards Program.

Should NATIX in the future need to transfer Personal Data outside the EEA, such transfer will only take place in accordance with the applicable safeguards required by GDPR, such as an adequacy decision under art. 45 GDPR or appropriate safeguards under art. 46 GDPR (for example, standard contractual clauses approved by the European Commission), and this Privacy Policy will be updated accordingly.

10. Data Retention

We retain your Personal Data processed under this Privacy Policy for three (3) years from the date on which you provided your opt-in consent. After this period, your Personal Data will be deleted or anonymised.

Your Personal Data will be deleted earlier upon your withdrawal of consent (see Sections 5 and 12), unless retention is required (i) to comply with applicable legal obligations, or (ii) to establish, exercise or defend legal claims, in which cases the data will be retained only for as long as strictly necessary for those purposes.

11. Measures Taken to Protect Data

We take the security of your data seriously. To protect your Personal Data, we implement a variety of appropriate technical and organisational security measures, including:

  1. System Access Control – preventing data processing systems from being used without authorisation.

  2. Data Access Control – ensuring that persons authorised to use a data processing system have access only to the data they are authorised to access, and that data cannot be read, copied, modified, or removed without authorisation during processing, use and storage.

  3. Transfer Control – ensuring that data cannot be read, copied, modified, or removed without authorisation during electronic transfer or when saving to data storage media.

  4. Separation Control – ensuring that data collected for different purposes is processed separately.

  5. Encryption – network traffic over public Internet is encrypted, and your Personal Data is stored encrypted at rest.

  6. Audit – we regularly audit the application of our security measures.

12. Data Subject’s Rights

You may exercise the rights with regard to your Personal Data at any time and without unjustified limitations, by contacting the Controller at [email protected]. Requests are filed free of charge and processed by the Controller within 30 days.

Specifically, you can:

  1. Obtain confirmation from the Controller as to whether or not your personal data is being processed, and obtain access to that data (art. 15 GDPR);

  2. Obtain from the Controller the rectification of inaccurate personal data (art. 16 GDPR);

  3. Obtain from the Controller the erasure of your personal data (“right to be forgotten”, art. 17 GDPR);

  4. Obtain from the Controller the restriction of processing (art. 18 GDPR);

  5. Receive your personal data in a structured, commonly used and machine-readable format, and transmit those data to another controller (right to data portability, art. 20 GDPR);

  6. Object to processing (art. 21 GDPR);

  7. Withdraw your consent at any time, with effect for the future, without affecting the lawfulness of processing based on consent before its withdrawal (art. 7(3) GDPR). 1. You can withdraw your consent and opt out of the Future Rewards Program at any time by sending an email to [email protected].

13. Complaints

You are always entitled to lodge a complaint with the competent supervisory authority for data protection in your country of residence, place of work, or the place of the alleged infringement, if you believe that the Controller’s processing of your Personal Data is in violation of applicable law.

14. Amendments

The Controller reserves the right to amend and update this Privacy Policy as a result of any new or revised laws and regulations on personal data protection, or for operational reasons. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the “Last update” date at the top, and – where appropriate – by contacting you using the contact information you provided. We encourage you to review this page regularly to stay informed.
